Fees and Refund Policy

1. Introduction: This policy provides the guidelines for charging fees for legal services, eBooks, and online services offered by Chamber of Prakash K. Pandya, a law firm offering mediation, negotiation, transaction advisory, litigation, insolvency services, eBooks, and other online services.

2. General Principles:

  • All fee arrangements will be transparent and mutually agreed upon.
  • Clients will be provided with a clear estimate or quotation of fees prior to the initiation of any service.
  • Services are offered only after the receipt of the agreed amount in advance.

3. Fee Structure and Payment:

  • 3.1 Legal Services:
    • Fees for legal services are determined based on the nature and complexity of the service.
  • 3.2 eBooks and Online Services:
    • The prices for eBooks and online services are fixed as indicated on our website or other platforms where they are offered.

4. Refunds:

  • 4.1 Legal Services:
    • General Refund Policy: Normally, no refunds are given for fees paid upon cancellation of legal services.
    • Special Circumstances: Under certain conditions, a client may be entitled to a full or partial refund for legal services, minus any costs already incurred by the firm.
  • 4.2 eBooks and Online Services:
    • eBooks: No refund shall be entertained under any circumstances for the sale of eBooks.
    • Online Services: Refund policies for other online services will be as per the specific terms and conditions provided at the time of purchase or subscription.

5. This policy shall be read with and is subject to the Client Fund Integrity, Authorization, and Indemnity Policy and the Anti-Bribery, Anti-Corruption, and Anti-Money Laundering Policy.

6. Dispute Resolution:

  • 6.1 Mediation: Any dispute arising from or related to fees, eBooks, online services, or the provision of legal services will first be addressed through mediation.
  • 6.2 Arbitration: If mediation doesn’t resolve the dispute, the matter will proceed to arbitration.
  • 6.3 Court Proceedings: If both mediation and arbitration are unsuccessful, the dispute may be settled in court.

All dispute resolution proceedings will:

  • Be conducted in English, unless agreed otherwise.
  • Abide by Indian laws.
  • Occur in Mumbai, India.

7. Amendments:

Chamber of Prakash K. Pandya retains the right to amend this policy as required. Clients will be promptly notified of any significant changes.

8. Acceptance:

Engaging the services of Chamber of Prakash K. Pandya, purchasing eBooks, or subscribing to online services signifies an agreement to the terms and conditions laid out in this Fees and Refund Policy. Unless otherwise agreed, the terms herein shall apply.
