By purchasing, downloading, or accessing the eBook titled “Case Laws Compendium for Limited Insolvency Examination”, in any edition, including the First Edition (2025) and the Second Edition (2026) (the “eBook”), you (“Purchaser” or “User”) agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not purchase or use this eBook.

1.1 Relationship with General Terms

These Terms and Conditions supplement, and are to be read together with, the general Terms of Use available at pkpandya.com/terms-of-use/. In case of any conflict between them:

  • These eBook Terms take precedence for matters specifically related to the eBook;
  • The general Terms of Use govern all other aspects of your use of pkpandya.com;
  • Both sets of terms are binding and complementary.

2. COPYRIGHT AND INTELLECTUAL PROPERTY

2.1 Ownership

This eBook, including all content, text, graphics, images, and compilation, is the exclusive intellectual property of Prakash K. Pandya and is protected under the Copyright Act, 1957, and other applicable intellectual property laws of India.

4. PROHIBITED ACTIVITIES

  • Compile screenshots, photographs or scans of its pages;
  • Upload any part of the eBook to an artificial-intelligence tool, chatbot or large language model, whether for summarising, question generation, analysis or training;
  • Modify, alter, adapt, or create derivative works;
  • Remove, crop, mask or alter any copyright notice, author attribution, licence details, watermark or other proprietary marking.

4.3 Commercial Exploitation

  • Use the eBook for any commercial purpose without written authorisation;
  • Incorporate content from the eBook into training materials, courses, or publications;
  • Resell, redistribute, or profit from the eBook in any manner.

5. DIGITAL RIGHTS MANAGEMENT (DRM)

5.1 Protection Measures

The eBook may contain digital watermarking, encryption, passwords or other technological measures to prevent unauthorised copying and distribution.

5.2 Circumvention Prohibited

You agree not to circumvent, disable, or interfere with any security feature or digital rights management system.

6. PERSONAL DATA EMBEDDED IN YOUR COPY (DIGITAL PERSONAL DATA PROTECTION ACT, 2023)

6.1 What May Be Embedded

Each copy of the eBook may be personalised. The following personal data furnished by you at the time of purchase may be embedded in your copy, visibly (for example, in page footers, a watermark or a licence box) or invisibly (for example, in document metadata or hidden identifiers):

  • Your name;
  • Your email address and/or mobile number;
  • Order or transaction ID and date of purchase.

6.2 Purpose

This data is used solely to identify the licensed copy, verify licence compliance, and detect, trace and act against unauthorised copying or distribution. It is not used for marketing on the strength of this clause.

6.3 Consent

By purchasing the eBook, you give your free, specific and informed consent to the processing of your personal data for the purpose stated in clause 6.2, including its embedding in your copy.

6.4 Retention

Purchase records are retained for so long as is necessary for licence administration, enforcement of these Terms, and compliance with applicable law, including tax and accounting requirements.

6.5 Your Rights

You may seek access to, correction of, or erasure of your personal data, withdraw consent, or raise a grievance by writing to pkpandya.ebook@gmail.com. Withdrawal of consent operates prospectively and does not affect processing already carried out. Data already embedded in a copy delivered to you forms part of that file and cannot be recalled from it.

6.6 Privacy Policy

Processing of personal data is also governed by our Privacy Policy.

7. INSTITUTIONAL AND BULK LICENCES

7.1 Educational Institutions

Educational licences permit use within the licensed institution for educational purposes only, subject to the number of authorised users specified in the purchase agreement.

7.2 Corporate and Law Firm Licences

Team, Department, and Enterprise licences are governed by separate licence agreements specifying authorised users and usage parameters.

7.3 Licence Coordination

Institutional licences are governed by separate written agreements that supplement both these Terms and the general Terms of Use. Institutional purchasers should review all applicable terms.

8. BREACH AND ENFORCEMENT

8.1 Violation Consequences

Any unauthorised use, reproduction, conversion or distribution constitutes a material breach of these Terms and may result in:

  • Immediate termination of your licence;
  • Legal action for copyright infringement;
  • Claims for damages and injunctive relief;
  • Criminal prosecution under applicable laws.

8.2 Monitoring and Detection

We reserve the right to monitor usage and investigate suspected violations through technological and legal means, including tracing the embedded identifiers referred to in clause 6.

8.3 Enforcement Coordination

Violations of these Terms may also constitute violations of our general Terms of Use. We may enforce both sets of terms concurrently, including suspension or termination of website access in addition to eBook-specific remedies.

9. DISCLAIMER AND LIABILITY

9.1 Content Disclaimer

10. REFUND POLICY

10.1 Digital Product Nature

Due to the digital nature of the product and immediate access upon purchase, no refunds are provided except as required by applicable consumer protection laws.

10.2 Defective Product

If the eBook file is corrupted or defective, contact us within seven (7) days of purchase for a replacement copy.

11. UPDATES AND NEW EDITION

11.1 Second Edition Purchasers

Purchasers of the Second Edition (2026) receive complimentary content updates for six (6) months from the date of purchase.

11.2 Upgrade for First Edition Purchasers

Purchasers of the First Edition may obtain the Second Edition (2026) as follows:

11.3 How to Claim

Write to pkpandya.ebook@gmail.com from the email address used at purchase, quoting the order or transaction ID and date of purchase. The upgraded copy is issued on verification of the original purchase and is subject to these Terms in full, including clause 6.

11.4 Non-Transferability

Upgrade entitlements are personal to the original purchaser and cannot be transferred or exchanged for cash.

12. GOVERNING LAW, DISPUTE RESOLUTION AND JURISDICTION

12.1 Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India.

12.2 Dispute Resolution

Any dispute arising out of or relating to this eBook or these Terms shall be resolved in the following sequence:

  1. Negotiation between the parties for fifteen (15) days from written notice of the dispute; failing which
  2. Mediation under the Mediation Act, 2023, which includes conciliation; failing which
  3. Arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996.

The seat and venue of mediation and arbitration shall be Mumbai, Maharashtra, India, and proceedings shall be conducted in English.

12.3 Urgent Relief

Nothing in clause 12.2 prevents the author from approaching a competent court for urgent interim or injunctive relief against infringement of copyright or breach of the licence.

12.4 Consumer Rights

Nothing in clause 12.2 limits any remedy available to the purchaser under the Consumer Protection Act, 2019.

12.5 Exclusive Jurisdiction

Subject to clauses 12.2 to 12.4, the Courts at Mumbai, Maharashtra, India shall have exclusive jurisdiction.

13. GENERAL PROVISIONS

13.1 Entire Agreement

These Terms, together with the general Terms of Use, constitute the entire agreement between you and the author regarding the eBook and supersede all prior communications.

13.2 Severability

If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.3 Amendment

These Terms may be updated from time to time. Continued use after modification constitutes acceptance of the revised Terms.

13.4 Assignment

You shall not assign or transfer your rights under these Terms without written consent.
